$6.5 Million Jury Verdict in Failure to Ventilate Patient in Acute Respiratory Distress

Kastriot Sadiku, a 29-year-old student who had used oxycodone, went to a hospital suffering from vomiting and impaired respiration among other symptoms. He was seen by an internist, Dr. Joseph Hederman, who gave Sadiku supplemental oxygen and began to monitor his heart and blood oxygenation.

When Sadiku’s condition worsened, he was attached to a respirator.

About an hour and half later, Dr. Hederman consulted an intensivist, Dr. Steven Bonzino, who diagnosed acute respiratory distress. Dr. Bonzino adjusted Sadiku’s supplemental oxygen.

Sadiku sustained cardiac arrest. He can no longer function independently and requires 24-hour-a-day care.

Sadiku’s father, on his behalf, filed a lawsuit against Dr. Hederman claiming that the doctor chose not to timely and appropriately intubate and ventilate Sadiku.

The plaintiff’s claim that Dr. Hederman chose not to follow the specific protocol for ventilating patients in acute respiratory distress was also part of the lawsuit. In addition, it was claimed that the hospital where Sadiku was brought was vicariously liable for Dr. Hederman and Dr. Bonzino’s combined negligence.

The jury entered its verdict of $6.5 million finding that Dr. Hederman was 26% responsible for Sadiku’s injury and harm.

The attorney representing the Sadiku family was James Wilkens.

At the jury trial, the experts testifying on behalf of Sadiku included a pulmonologist, a physical rehabilitation expert and a neurologist.

At trial, the defendants retained experts in critical care medicine and life-care planning.
